The DPA contains a series of provisions that can be grouped together under the title ‘transparency’. These transparency provisions provide the foundations of data protection laws providing a fundamental level of protection for the privacy of personal data undergoing processing. It might seem obvious, but it is worth saying it all the same; an individual’s privacy is better protected when the individual is properly informed about the data controller’s activities.
The DPA’s principal transparency provisions were identified in the previous chapter. To recap, they are:
the promotion of consensual processing;
the requirement of fair processing;
the requirement for specified processing purposes;
notification;
the right of access to personal data;
information notices.
