THE RIGHT TO OBJECT AND THE SIXTH DATA PROTECTION PRINCIPLE

The sixth data protection principle says that ‘personal data shall be processed in accordance with the rights of data subjects under this Act’. In light of the interpretation in Schedule 1, Part II of the DPA, the failure to comply with any of the rights to object, apart from the right to object in respect of exempt manual data, will amount to a breach of the sixth data protection principle. Failure to comply with the sixth data protection principle can justify the Information Commissioner taking enforcement action.
